1. Definitions

• "Aman Retreats," "we," "us," "our" — the company operating this website and managing the listed properties, registered in Malaysia at 3 Jalan Tun Fuad Stephens, 88000 Kota Kinabalu, Sabah.
• "Guest" or "you" — any individual who enquires about, books, or occupies an Aman Retreats property.
• "Property" — any of the properties listed on this website for monthly rental.
• "Agreement" — the written rental agreement entered into between Aman Retreats and the Guest for a specific property.
• "Services" — property rental and all associated staff services included in the monthly rate.

2. Acceptance of Terms

By using this website or submitting an enquiry, you confirm that you are at least 18 years of age, legally capable of entering into a binding agreement, and acting on your own behalf or with authority to act on behalf of a group. These terms apply to all visitors, enquirers, and guests.

3. Service Description

Aman Retreats offers monthly rental of three residential properties in Sabah, Malaysia. Each property includes a defined level of staffing and services as described on our website. Availability is subject to scheduling and confirmed only upon execution of a written Agreement.

We reserve the right to decline any rental enquiry at our discretion, without obligation to provide a reason.

4. Rental Agreement

A rental is not confirmed until a written Agreement has been signed by both parties and the required deposit has been received. The Agreement will specify:

• The property and rental period
• The monthly rental rate and all included services
• Deposit amount and refund conditions
• Guest capacity and permitted use
• Specific house rules for the property

In the event of any conflict between these Terms and the written Agreement, the Agreement shall prevail.

5. Payment Terms

All amounts are quoted and payable in Malaysian Ringgit (RM) unless otherwise agreed in writing. Payment arrangements include:

• A refundable security deposit paid at the time of Agreement signing
• The first month's rental paid in advance prior to or on the commencement date
• Subsequent monthly payments due on the same calendar day each month

We accept Malaysian bank transfers. International wire transfers are available for overseas guests on request. Late payment may result in suspension of staff services or, in persistent cases, termination of the Agreement.

The security deposit will be returned within 14 days of departure, subject to deductions for any damage beyond fair wear and tear, as documented in the property condition records.

6. Guest Responsibilities

By entering into a rental Agreement, you agree to:

• Use the property for residential purposes only, unless otherwise agreed in writing (events at the Estate require prior written approval)
• Respect the property, its contents, and the surrounding environment
• Comply with Malaysian law at all times during occupancy
• Not sublet or assign the property to any third party without written consent
• Not exceed the maximum guest capacity specified in the Agreement
• Maintain the property in reasonable condition and report any damage promptly
• Respect the privacy and working conditions of all resident staff

7. Prohibited Activities

The following are not permitted at any Aman Retreats property:

• Any activity that is unlawful under Malaysian federal or Sabah state law
• Commercial filming, photography, or media production without prior written approval
• Modification of the property or its contents without consent
• Any activity that poses a risk to the marine park environment adjacent to coastal properties
• Hosting commercial events or paying gatherings without prior agreement

8. Intellectual Property

All content on this website — including text, photographs, and design — is the property of Aman Retreats or its licensors. You may not reproduce, distribute, or use any content for commercial purposes without written permission.

9. Service Standards and Limitations

We take care to maintain properties to a consistent standard. However, we do not commit to the absence of minor inconveniences that may arise in tropical environments, including maintenance requirements, seasonal weather conditions, or the presence of local wildlife. All material issues raised by guests will be addressed within the timeframes specified in our support commitments.

Service descriptions on this website are accurate at the time of publication. We reserve the right to make reasonable adjustments to staff arrangements or amenities provided that the overall standard of the rental is not materially diminished.

10. Disclaimers

Our services are provided on a reasonable-efforts basis. We do not represent that any property will be free from interruptions, that third-party services (such as utilities) will be uninterrupted, or that any specific outcome will result from a stay at our properties. This website is provided "as is" and we make no representations about its accuracy or completeness.

11. Limitation of Liability

To the extent permitted by Malaysian law, Aman Retreats' total liability to a guest arising from or related to a rental Agreement shall not exceed the total rental amounts paid for the month in which the issue arose. We shall not be liable for indirect, consequential, or incidental losses, including loss of enjoyment or travel expenses.

12. Termination

Either party may terminate a rental Agreement with 30 days' written notice. Aman Retreats reserves the right to terminate with immediate effect in the event of a material breach of these Terms or the Agreement by the Guest. In such cases, the security deposit may be forfeited and no refund of advance rental payments will be made for the affected month.

13. Governing Law and Disputes

These Terms and all rental Agreements are governed by the laws of Malaysia. Any dispute arising from these Terms or an Agreement shall first be subject to an informal resolution process — both parties agree to communicate in good faith for a period of 14 days before initiating any formal proceedings. If informal resolution is not achieved, disputes shall be referred to the courts of Sabah, Malaysia, which shall have exclusive jurisdiction.

14. General

• Entire agreement: These Terms, together with any written rental Agreement, constitute the entire agreement between the parties for any specific rental.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
• No waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in future.
• Notices: Formal notices should be sent by email to [email protected] or by post to our registered office address.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or submission of a new enquiry after the effective date constitutes acceptance of the revised Terms.
